Terms of Service

These Terms apply to the NeverMiss AI website, demonstration, and any services provided by Team Hartley Professional Services LLC (“NeverMiss AI,” “we”). By using the service, a business customer agrees to any applicable order, subscription terms, and these Terms. If a separate written agreement conflicts with these Terms, the written agreement controls.
Service description
NeverMiss AI provides automated telephone answering and information capture. AI-generated responses and summaries may contain errors, omissions, or transcription inaccuracies. Customers must review service requests and independently confirm important information before relying on it.
Customer responsibilities
Customers must provide accurate configuration information, maintain lawful call-forwarding arrangements, comply with applicable laws including call-recording and privacy requirements, and avoid using the service for emergencies or safety-critical communications without appropriate independent arrangements. The service is not a substitute for emergency services.
Availability and limitations
Service may be affected by telephone networks, AI providers, internet connectivity, maintenance, and third-party outages. We do not guarantee uninterrupted operation, that every call will be answered, or that any particular sales or business results will occur.
Subscriptions and payments
Paid plans, fees, usage allowances, renewal periods, trial details, and any overage charges will be disclosed at signup or in an agreed order before charges begin. Annual subscriptions, when selected, are paid upfront for 12 months at the price of 10. Included call minutes renew each month and do not roll over. Additional call minutes are billed separately monthly at the disclosed overage rate. Pricing changes during a prepaid annual term do not change the agreed base subscription price for that term. Renewal pricing and cancellation terms will be disclosed before authorization. We will not automatically convert a free trial into a paid subscription without the customer's authorization of the applicable paid terms.
Prohibited use
Do not use the service for unlawful, fraudulent, abusive, harassing, or deceptive purposes, or to collect sensitive information beyond what is reasonably needed for your configured workflow.
SMS Notifications
NeverMiss AI, operated by Team Hartley Professional Services LLC, offers optional automated text message notifications to enrolled business customers and their authorized personnel. Messages provide operational alerts about calls handled by our AI receptionist, including service requests, caller callback information, and appointment inquiries. SMS notifications are not marketing messages.
Recipients must agree to receive notifications before enrollment. Message frequency varies based on incoming call activity and may be recurring. Message and data rates may apply. Enrollment in SMS notifications is optional and not required to use our AI receptionist service.

Mobile carriers are not liable for delayed or undelivered messages. SMS delivery depends on telecommunications providers and network availability; NeverMiss AI cannot guarantee immediate or uninterrupted delivery. Important or urgent requests should be confirmed independently.
Changes and termination
Customers may request cancellation under our Cancellation and Refund Policy. We may suspend or terminate service for nonpayment, unlawful use, or material security risks, subject to applicable law and any agreed terms. Material changes to paid service terms will be communicated as appropriate.
Legal limitations
To the extent permitted by applicable law, the service is provided without warranties of uninterrupted availability or error-free AI output. Any liability limitations in a signed customer agreement will apply. Nothing in these Terms excludes rights that cannot legally be waived.
